AKA serves letter of demand on SABC to cancel “The Braai Show”

Cassper Nyovest, on the other hand, is adamant that the show will go on.

Fans of “The Braai Show” will know all about the drama taking place between AKA and Cassper Nyovest. AKA was recently sacked as the show’s presenter and replaced with Cassper. Now, AKA has served a letter of demand on the SABC to force them to take Cassper off of the show as part of a legal battle to reinstate him as the show’s host.

AKA’s legal team said that he closed a deal with the producers of “The Braai Show” in March last year to create content that would be uploaded to AKA TV. 

“In accordance with the agreement, the parties agreed that the entire copyright (whether vested contingent or future) and all other rights in and to the work created, including merchandising or remake rights of whatsoever nature would be jointly vested in the parties, being MakhudoCom and our client,” part of the letter of demand read.

In October, though, the company announced that it could no longer afford the costs of production and gave all its rights to another production company. By doing this, Cake Media became joint right owners with AKA.

“As a result, Makhudu entered into a Deed of Cession and Assignment Agreement with Cake Media wherein Makhudu ceded all its rights and entitlement to the show to Cake Media, in exchange for Cake Madia settling owed and future production costs,” the letter reads further.

AKA’s legal team confirmed that at the start of this year, Cake Media was approached by the SABC to start shooting the second season of “The Braai Show”. It was apparently understood that AKA would be the main personality behind the show.

“Our client was engaged in these discussions and on board to continue as the host of the show and/or as the main industry personality in the second season when negotiations commenced,” they argue in the letter.

The muso and his legal team admit that the tragic events in April led to a situation where he was unable to fulfill his role as presenter and subsequently, had to step down. What they are demanding, however, is that his apparent 50% legal stake in the show be recognised. If this demand is adhered to, any contracts the production team concluded with third parties, like Cassper Nyovest who is now the new host of the show, will be void because not all parties with a legal say agreed to the conclusion thereof.

Cassper Nyovest has added his voice to the debate by tweeting that the show will air on the dates previously announced by the SABC. 

Nyovest added that “people are just making senseless noise”. According to the presenter, he has already been paid in full for the gig on “The Braai Show” and he is not personally involved in the legal affairs.

“I am in no way attached to anything here. I got paid for a service. I delivered a service and I damn well enjoyed shooting #TheBraaiShowWithCass. It is shot already, I got paid already. It’s funny looking at people arguing about something that’s done,” one of his tweets read. 

The SABC responded to the letter of demand by confirming that they have received it. However, they remain unmoved in their belief that Cake Media wholly owns the show and therefore has full contractual capacity.

AKA has given the SABC 48 hours to respond formally to the letter of demand. If they do not comply, he will apply for an interdict against them to stop the show from airing on 8 September 2021.
